Commissioned Paintings

If you would like to commission Terry to do a painting from a landscape photo you took yourself (he cannot work from copyrighted images) please contact the artist.  The photo you select for the painting should be in sharp focus and, if a digital photo, have a large enough file to allow enlargement to see details.  The artist would be happy to advise you on what photo would make the best painting.  Contact the artist about doing a painting of one of your vacation photos or a portrait of your house or boat based on your photos.

The four national park paintings seen above were commissions.  In all cases, the collector ordering the paintings granted the artist full copyright rights for the paintings created.  Terry was permitted to make improvements to the reference photo, adding or subtracting minor details, changing the sky, etc. to produce the best painting possible, comparable in quality and style to the artist's other work.  The painting may take up to 3 months to complete, depending upon drying time between paint layers and the artist's travel schedule.

Upon completion, buyer's approval, and receipt of payment (personal checks require 10 business days to clear the bank), the paintings will be mailed to the collector (or may be picked up at the artist's residence).  Payment may also be arranged online through PayPal.

The contracted price for a commissioned painting will depend on size and complexity.  Landscapes of a larger size will show more detail and will look more impressive on a wall.  Paintings are sold unframed.

Typical prices for unframed commissioned paintings of average difficulty:

30" x 40" - $2400
24" x 30" - $1750
22" x 28" - $1550
18" x 24" - $1080

Prices for a more difficult scene (for example: the Telluride street scene) may be 25 - 30% higher than one of average difficulty.

The parties agree as follows:

1.      The Project: Collector is commissioning an oil painting on canvas created by the Artist. Subject matter is to be based on the attached photo created by the patron ___________ and is guaranteed not under copyright by a third party. The painting will be completed within 3 months of the signing of this agreement. The commission will not include framing, which the collector will choose and pay for.

2.      Right of Refusal: It is the intent of this contract that the Artist creates a painting for the Collector that the Collector will purchase. However, if, after the work is completed, the Collector does not wish to purchase the work, the Collector may refuse to accept the finished painting. In that case, the Artist will retain the refused artwork and the nonrefundable deposit, free of any claims or interests of the Collector and the Collector will owe no additional fees to the Artist.

3.      Copyright: Artist reserves the copyright to any painting commissioned by Collector that is created by the Artist, including all reproduction rights and the right to claim the copyright for the painting, even though it is based on a photo created by the collector.

4.      Payment Amounts: size and selling price will be decided by the parties. Selling price will be based upon canvas size and complexity of completed work and will be consistent in style and quality with other comparable works by Artist at the time of sale. Parties will agree to price in writing prior to the commencement of each artwork.

5.      Payment Terms: A nonrefundable deposit of one-third of the selling price is required before work commences. Payment in full is due upon receipt of the completed artwork which will be picked up at the artist’s home in Wilmington soon as possible after the collector is notified by email that the painting is finished. A photo of the completed painting will be attached to the email.
